Heartyculture provides an online marketplace that enables you to purchase nutraceuticals, personal care items, everyday staples, wellness products, and other goods that support conscious and healthy living. 

We act only as an intermediary under the Information Technology Act, 2000.
All contracts for sale of products are solely between you and the seller/manufacturer.

Even where Heartyculture branding appears on products, the seller remains responsible for quality, liability, and compliance.


3. Registration & Account

You may browse without registering. However, to place orders you may register or checkout as a guest.

You agree to:

  • Provide accurate information

  • Maintain confidentiality of login details

  • Accept all responsibility for activities under your account

If you register using third-party platforms (Google, Facebook, etc.), you authorize us to receive information permitted under those platforms. 


4. Privacy Policy

To provide services, we may collect personal and sensitive information such as name, email, phone number, address, payment details, and device identifiers.
We may also use cookies, tags, and similar technologies. 

Our Privacy Policy outlines how we collect, store, use, and share your data. By using the Website, you consent to such practices.

If your order is cancelled, we will refund any amount you have paid in accordance with our Refund Policy. 


8. No Endorsement

Listing of products does NOT constitute endorsement, warranty, or guarantee of product quality by Heartyculture.
Sellers are solely responsible for accuracy of product details and compliance. 


9. Delivery Mechanism

We partner with third-party logistics providers to deliver your orders. Delivery fees (if applicable) will be displayed during checkout.
You agree to provide accurate addresses and accept risks of delays caused by courier partners. 


10. Payment Terms

Browsing is free of cost. Purchases must be made using authorized payment gateways.

You acknowledge that:

  • Payment data is encrypted and processed by third-party providers

  • Heartyculture does not store your financial details

  • Heartyculture is not responsible for loss arising from payment gateway errors 

If your order value is ₹2,00,000 or more, you must upload a valid PAN card within 4 days, failing which your order may be cancelled. 


11. Cancellation, Replacement & Refund Policy

Order Cancellation:
Orders may be cancelled only before the shipping ID is generated or before the cancellation option is disabled.

Refunds & Replacements:

  • If a product is damaged, report within 24 hours of delivery

  • If unsatisfied, request replacement/refund within 7 days

  • Approval and processing are subject to our inspection and policies displayed on the Website 


12. Disclaimer of Warranties

All services and products are provided “as is” and “as available”, without warranties of any kind.
We do not guarantee reliability, availability, or error-free operation of the Website or product quality.
All risk associated with product purchase lies solely with you. 


13. Limitation of Liability

To the fullest extent permitted by law, Heartyculture shall NOT be liable for:

  • Loss of profits, revenue, business, or data

  • Indirect, incidental, or consequential damages

  • Any issues arising from use of third-party services or payment gateways

  • Product defects, delays, or disputes with sellers or courier partners 

Your sole remedy is to stop using the Website.

You agree to indemnify Heartyculture, its officers, employees, affiliates, and partners from any claims arising out of:

  • Your breach of these Terms

  • Violation of law

  • Infringement of third-party rights

  • Actions or inactions of sellers or logistics partners 

You expressly release Heartyculture from any liability relating to sellers or third-party partners.


15. Account Deactivation / Opt-Out

To deactivate your account, unsubscribe from communication, or discontinue services, email us at care@heartyculture.com.


16. Electronic Communication

By using the Website, you consent to receive electronic communication from us.
Email notifications sent to your registered email will be deemed delivered. 


17. Intellectual Property

All text, graphics, images, content, software, and branding on the Website belong to Heartyculture or its licensors.
You may not copy, modify, reproduce, or republish any portion without written permission.
Unauthorized usage may lead to legal action. 


18. Viruses & Security

You must not introduce viruses, attempt unauthorized access, or disrupt Website operations.
Any such act may lead to termination and legal consequences under applicable Indian laws.

You may post reviews or comments as long as they are lawful, non-abusive, non-defamatory, and non-infringing.
By posting, you grant Heartyculture a perpetual, royalty-free, global license to use such content.

21. Governing Law & Jurisdiction

These Terms are governed by the laws of India.
Courts of Hyderabad, Telangana shall have exclusive jurisdiction.
